Arkansas Supreme Court strikes down law barring Gay Adoptions


The Arkansas Supreme Court upheld a decision to strike down a state law barring gay couples and unmarried couples from being adoptive or foster parents.
The law, approved by voters in a 2008 ballot initiative, violates constitutional privacy rights, the court held. 
“The choice imposed on cohabiting sexual partners, whether heterosexual or homosexual, is dramatic,” Justice Robert Brown wrote for the court. “They must chose either to lead a life of private, sexual intimacy with a partner without the opportunity to adopt or foster children or forego sexual cohabitation and, thereby, attain eligibility to adopt or foster.”

The Arkansas ruling follows a decision last year in Florida, which we wrote about here, striking down a Florida state ban on adoption by gays.

“The intent behind the [Arkansas] law was to try to prevent gay and lesbians from adopting or serving as foster parents,” said Garrard Beeney, a partner at Sullivan & Cromwell who represented couples challenging the law. “This is another step in the direction of striking down laws based on stereotypes and advancing efforts to place children in loving homes.”

The suit was brought by the American Civil Liberties Union, which also hailed the ruling.  “The ban did nothing positive,” ACLU lawyer Christine Sun said in a statement. “It required the government to intrude into the private lives of Arkansans for no child welfare purpose at all. We are relieved that the court agreed that the law is unconstitutional.”

Westboro Freaks are going to support Clint McCance


Frakking Westboro! These fools are heading to Clint's town to protest for his rights.

The Advocate reports:
The fiercely antigay Westboro Baptist Church may be planning a protest outside Midland High School in Arkansas, following the resignation of the school board's homophobic vice president.

According to the the Cotton Club blog, members of the Topeka, Kan.–based family church plan to descend on Pleasant Plains, Ark., on Wednesday, ostensibly because Midland board member Clint McCance was forced from his job last week.

WATCH Anderson Cooper talk to Clint McCance... Clint said he will Resign

McCance said that he has received an outpouring of criticism over his comments, including "thousands of phone calls, hate mails, people threatening to kill my family and me."
He said he has sent his wife and two kids out of the state because of fears for their safety and that he is installing a security system at his home.
"I'm reaping what I've sown," he told CNN. "I've had a lot of hate speech thrown at me and my family on every level."
He said he would resign from the school board to spare the district the bad press and distractions of dealing with the fallout from his comments. "If they decide after five or ten years to vote me back in, then I'll run again," he said.

The Arkansas Department of Education has condemned Clint McCance's Anti-Gay remark

Yes, the finally said something! The Arkansas Department of Education condemned Clint's dumbass, anti-gay messages he posted on Facebook.
Here's their statement:

The Arkansas Department of Education has prepared a statement regarding the Facebook posting of Midland School Board member Clint McCance:
The Arkansas Department of Education strongly condemns remarks or attitudes of this kind and is dismayed to see that a school board official would post something of this insensitive nature on a public forum like Facebook. Because Mr. McCance is an elected official, the department has no means of dealing with him directly. However, the department does have staff who investigate matters of bullying in schools and we will monitor and quickly respond to any bullying of students that may occur because of this, as we have with other civil rights issues in the past.
